Since 2019, spouses of Hungarian citizens fall under the third-country nationals regime (2023. évi XC. törvény), not the EU free movement act. The permit is filed at OIF (Országos Idegenrendészeti Főigazgatóság — immigration police).

Note on criminal record check (RCMP): The OIF family reunification factsheet does not list a criminal record certificate as a mandatory upfront document. An RCMP check IS required later for a national residence card (permanent settlement). Confirmed by Hungarian consulate Vancouver (April 2026 call).

This certificate covers lawful stay even if the 90-day visa-free period expires. Important: This certificate is only issued with in-person submission, not via the Enter Hungary electronic platform. Apply within the first month to allow buffer.

First Weeks in Hungary

  1. Week 1–2: Get tulajdoni lap (property deed extract) from land registry — must be max 30 days old at filing
  2. Week 2–3: File residence permit at OIF in Eger. Receive interim stay certificate immediately — this secures lawful stay.
  3. Week 3+: Residence permit should be processed within 21 days of filing. Card issued. Address registration (lakcímbejelentés + lakcímkártya) happens after permit approval.
